Why Mediate?

It Saves you Time & Money

Mediation is a fast, cost-effective way to sort out disputes. Mediators are completely impartial and help conversations move forwards when things are stuck, enabling both parties to hear and to be heard. Everything discussed during the mediation process is confidential and cannot be used in court proceedings now or in the future. You remain in control of the process and can actively participate in agreeing an outcome which meets your interests and needs

You Stay in control

No solution can be imposed upon you. The aim of a mediation is to produce an agreement which works for all those involved. The range of issues and potential outcomes which can be aired in a mediation can be far more extensive and creative than those which are put before a court in legal proceedings. The court is required to consider legal rights and liabilities whereas in a mediation we can include other issues - and to work to incorporate what you need to happen and your genuine interests which may range beyond the purely legal. In family mediation, poor communication is often at the heart of the conflict. We can help you to establish how you communicate within the separation process and (particularly where children are involved) how you manage communication going forwards. Engaging a Mediator

Before we start

In order for the mediation process to run as smoothly as possible, we contact both parties in advance and if appropriate have a pre-mediation meeting or discuss the practical points and key issues in the dispute

When

Mediation can take place the day after the conflict has happened if a specific event has triggered a situation. Or, we can mediate where legal proceedings have started. If requested to, the court may agree to a stay of these proceedings (i.e. to suspend any further action in the proceedings) pending the outcome of the mediation

Alternatively

The mediation can run alongside the legal action. Those considering mediation in this situation should discuss whether they would like to make this kind of application with their legal advisers. Careful attention should be given to any legal time limits in any event

What happens next?

Agreement is reached during the mediation sessions and where appropriate, we will provide a written statement describing the outcome. If agreement wasn't reached, we can provide a follow-up service: either further mediation meetings or a referral to arbitration where appropriate.
